Arbitrability of disputes arising from public procurement contracts

The article “Arbitrability of disputes arising from public procurement contracts – Lithuanian example” written by our firm’s representatives was published in Social Science Research Network (SSRN) e-journal.

The article is focused on a recent Ruling of the Supreme Court of Lithuania which analysed the issue of arbitrability of disputes arising under public procurement contracts. A thorough analysis of the Ruling and submit is provided together with a critical approach arguing that the respective Ruling is subject to a lot of criticism because of its grounds and basis which contradict the modern practice of international arbitration and the case-law of the European Court of Justice.
