Defended the creditor’s interests in the enforcement proceedings

Another victory in the great war. The client’s shareholder had unsuccessfully initiated many lawsuits against the client (an aviation company) for the past three years.

It‘s noteworthy that all of these lawsuits were dismissed and the cases resulted in the victory of our client. Nevertheless, the opponent categorically refused to reimburse the client for the litigation costs awarded on the grounds of the alleged set-off. After the client initiated the forced recovery of the debt, the opponent appealed the bailiff’s actions to the court and demanded the enforcement proceedings to be terminated. The court rejected the opponent‘s complaint and upheld our argument that if the client did not agree to the set-off, there was no reason to terminate the enforcement proceedings.

Hopefully, this victory will ultimately put an end to lengthy litigation.
