Case against the Lithuanian Competition Council

Our team has represented a publicly listed company in a case against the Lithuanian Competition Council in regard to a breached right of accessing a case file that was in the Competition Council’s possession. In this case the Supreme Administrative Court of Lithuania established that the Competition Council has a duty to ensure a person’s right to obtain information. The Supreme Administrative Court created a precedent, in that certificates from the concentration case files are deemed an integral part of concentration cases, therefore legal persons should have a right to gain access to these files.
