Case regarding recognition and enforcement of arbitral award

Motieka & Audzevičius acted as a strategic legal counsel in a case regarding the recognition and enforcement of a foreign arbitral award in the Supreme Economic Court of the Republic of Belarus. The arbitral award whose recognition and enforcement was being sought was handed down in Stockholm by the arbitral tribunal, composed under the rules of the Arbitration Institute of the Stockholm Chamber of Commerce in a dispute between a leading Lithuanian company group with a major focus on real estate and energy sectors and a construction company in Belarus.

The significance of the case lies in the nature of the case ‒ since Belarus is famous as being the last autocracy of Europe, the recognition and enforcement of foreign arbitral awards in Belarus is always complicated, especially if that award is rendered against the party which has a lot of governmental construction orders for building objects of state level importance (as it was in this case).
