Case regarding the validity of an unprofitable contract

Motieka & Audzevičius has represented a client before the Supreme Court of Lithuania in a case regarding the validity of an unprofitable contract. The client, an insolvent company, brought a claim against a former shareholder of the company and requested the court to declare the contract null and void.

The court of the first instance, as well as the court of appeal, ruled in favour of the client, stating that the contract had infringed the interest of the creditors of the company. When the counterparty submitted its cassation appeal, our team was successful in securing the client’s interest in the Supreme Court of Lithuania, where the cassation appeal of the counterparty was dismissed and the client was granted over 1 million euros.
