Cases regarding the legality of legislation on the financing scheme of the LNG Terminal

Motieka & Audzevičius is representing the operator of Lithuania’s natural gas transmission system in several cases regarding the legality of legislation on the financing scheme of the Lithuanian Liquefied Natural Gas (LNG) Terminal.

The Court of Appeal and Vilnius Regional Administrative Court have both made decisions to stay proceedings and submit requests to the Constitutional Court in order to examine whether the provisions of the Law on Liquefied Natural Gas Terminal comply with the Constitution.

Kaunas Regional Court, in hearing a related case, has decided to stay proceedings until the Constitutional Court’s decision has been reached.

The Constitutional Court‘s decision is expected to have a significant impact on the possibility to finance the Liquefied Natural Gas Terminal project.
