Defended the creditors‘ interests in the enforcement proceedings

Our Dispute Resolution team has successfully represented creditors in the proceedings for the recovery of more than EUR 16 million debt.

The debtors initiated the procedure of selling the seized property to the buyer proposed by the debtors, however, when another buyer offered an even higher price for the property, the debtors appealed against the bailiff‘s order whereby their property was set to be sold to the buyer that had offered the higher price.

The courts of both instances rejected the debtors’ appeal, noting that only the property interests of the debtors are protected in the enforcement proceedings, so the bailiff is not obliged to assess circumstances unrelated to the proposed price of the property.
