Dispute concerned the method of calculation of damages

Motieka & Audzevičius has successfully represented a client in the Supreme Court of Lithuania. The Supreme Court has annulled an earlier decision of the lower court, which was against our client’s interests.

The dispute concerned the method by which contractual damages had been calculated and the distribution of said damages among both parties. The case also dealt with the level of care that needs to be observed by a commercial entity in performing a contract and how this compares in the case of the consumer.
