Dispute regarding the compensatory allowances

Motieka & Audzevičius has successfully represented the co-founder and vice president of a major gas provider in a dispute regarding the unlawful dismissal of the vice president and request for compensatory allowances. The defendant tried to avoid its obligation to pay out the compensatory allowances which were provided in the employment contract of the client. The court of first instance satisfied the client’s claim fully – found the dismissal unlawful and obliged the defendant to pay the compensatory allowances.

This is the first time in case law where the award of a “golden parachute” in the case of unlawful dismissal was considered.
