Litigation concerning licensing conditions

Motieka & Audzevičius represented one of the largest media holdings in the Baltic countries in a litigation concerning licensing conditions. The client had an agreement with a Lithuanian telecommunication giant to allow the retransmission of their network television programme. The media holding and telecommunication company decided to change the license conditions; however the Radio and Television Commission (the Commission) rejected the proposal by a majority vote of two thirds.

Vilnius Regional Administrative Court rejected the Radio and Television Commission’s complaint on the obligation to take a formal decision and supported the decision of the Chief Administrative Disputes Commission. Finally, the Supreme Administrative Court of Lithuania rejected an appeal and noted that the Commission was required to take a formal decision about satisfying or rejecting licensing conditions changes, but not to send voting results for the inquirer.
