Prepare a procedure for periodic symptom screening of COVID-19

data protection experts

ATTENTION all manufacturing companies! Please note that as of 13 September the employees of manufacturing companies will be able to perform their work functions only after testing for COVID-19 periodically. The obligation of periodic testing will not apply to employees who have been already infected with COVID-19 or have been vaccinated.

What does this mean for manufacturing companies?

It will be required to draw up and keep up to date a list of employees who have contact with other persons at the place of work or activity and to inform the employees on this list of the obligation to test periodically to ensure that the employee is free from COVID-19.

It will be required to establish a procedure for periodic symptom screening to identify whether employees are infected with COVID-19, or not. The procedure should include:

  • how the periodic testing will be organized;
  • obligations of the employer and the employee;
  • the procedure for compiling the list of employees who need to test periodically for COVID-19;
  • aspects of personal data processing;
  • liability for employees who do not follow the procedure established by the employer;
  • other requirements arising from legal acts.

In a short period of time to prepare a procedure for periodic symptom screening of COVID-19 can become a real challenge to an employer. However, employers who will not ensure that work functions are performed only by employees who have been already infected with COVID-19 or have been vaccinated and have medical records to prove the person is healthy and free from COVID-19 will be liable for administrative offense and will have to pay a fine of up to six thousand euros.
