Represented creditors in personal bankruptcy case

Our Dispute Resolution team successfully represented creditors in a personal bankruptcy case.

The debtor requested to reopen proceedings of his bankruptcy case that was terminated in 2018 due to the unfairness and concealment of information regarding the scope of debt and creditors (our clients). Contrary to the debtor’s statements, we pointed out to the court that the request was based on false circumstances and was intended to circumvent the prohibition on the initiation of bankruptcy proceedings for the next 10 years after the bankruptcy proceedings were terminated. We also requested that the debtor be fined for abuse of procedural rights.

The Vilnius City District Court agreed to all of our clients’ arguments, refused to reopen bankruptcy proceedings and even imposed a symbolic fine on the debtor for abuse of the procedural rights.
