Represented in an investigation commenced by the Competition Council

Law firm Motieka & Audzevičius has represented a premises accommodation administrative services provider in an investigation commenced by the Competition Council of Lithuania. The Competition Council sought to ascertain whether a merger that had been completed by the client would significantly restrict competition in the relevant markets.

In this case, the client was not required to give notice as to the concentration since the income of the undertakings in question did not reach the threshold determined by the Law on Competition of Lithuania. This was the first case in which the Competition Council had commenced this kind of investigation on its own initiative, after having expressly stated its doubts on the merger’s compatibility with the merger rules.

Nevertheless, the Competition Council announced an unconditional clearance for the transaction.
