Our team has represented one of the largest Lithuanian agriculture companies in a dispute relating to the application of interim measures.

Motieka & Audzevičius lawyers entered the case only at the enforcement proceedings stage. Following a decision by the Court of Appeal, enforcement proceedings against our client were initiated. The team of Motieka & Audzevičius applied to Kaunas Regional Court for interim measures – to withhold enforcement proceedings. Kaunas Regional Court accepted the application of interim measures and enforcement proceedings were withheld due to inappropriate bailiff jurisdiction.

Before Motieka & Audzevičius entered the dispute, Panevezys county court had decided that our client did not execute an agreement by which it had committed to purchase a respective amount of agriculture products and of which the other party had committed to sell. The company filed a complaint with the Court of Appeal of Lithuania, however the decision was not overruled.
