Represented a real estate developer regarding the Order of the Department of Cultural Heritage

Our team represented a real estate developer in connection with the Order of the Department of Cultural Heritage under the Ministry of Culture of Lithuania, which eliminated the previous adjustments for the construction of an apartment building in the Old Town of Vilnius.

The Department of Cultural Heritage recognised that the plans of the client to build a multi-apartment house could violate the Vilnius Old Town Protection Regulation and thus adversely affect this cultural heritage monument. Vilnius District Administrative Court satisfied our client’s claim and stated that The Department of Cultural Heritage had unjustifiably issued the Order.

The court acknowledged that the appeal against the Order of the Department of Cultural Heritage was not motivated and, in the present case, the imperfections of the actual justification of this Order are essential.

The present case will pave the way for the formation of judicial practice in matters regarding to the protection of real estate developers’ rights to design and coordinate real estate development projects in the areas of cultural heritage
