Victory at the Court of Appeal for Norwegian client regarding quality of the supplied goods

A client, which sells electronic products, has entered into a distribution agreement with a counterparty.

The dispute arose from a claim by the buyer of the goods that the goods sold were possibly counterfeit. On that basis, the buyer withheld the amounts due to our client.

After the claim for debt was brought before the court, the Court of First Instance upheld our claim in full, confirming that the opponent’s criticism of the quality of the goods sold was unfounded.

When the distributor disagreed with the judgment, the dispute went to the Court of Appeal.

The Lithuanian Court of Appeal fully agreed with the arguments of our Dispute Resolution team and upheld the judgment. The Court dismissed the distributor’s appeal in its entirety as unfounded on the basis of the judgement, rendered by the Court of First Instance.
