Represented an audiovisual service provider and distributor

Our team has represented an audiovisual (television) service provider and distributor in a dispute with the Lithuanian Radio and Television Commission in respect of the legality of retransmission limitations for a TV programme.

We have challenged the decision of the Commission to adapt broadcasting restrictions in court and has indicated that such restrictions were in breach of European Union law, in particular the European Union Directive on audiovisual services (restrictions were applied without the sanction of the European Commission), and therefore has violated the basic principles of fair competition and public administration.

The first instance court dismissed the claim and concluded that the client is not a concerned person who is entitled to file a complaint before the court. Subsequently, the Claimant appealed to the Supreme Administrative Court of Lithuania. The Lithuanian Supreme Administrative court has left the first instance court decision unchanged.
