Represented one of the largest Lithuanian biomass suppliers

Our firm has represented one of the largest Lithuanian biomass suppliers before the Lithuanian Competition Council.

In this case the Competition Council has investigated a suspected anticompetitive vertical agreement between the client and a Vilnius based major central heating and electricity provider. According to the Competition Council, the investigated agreement included an exclusive purchase clause, had a market foreclosure effect and could have resulted in a heating price increase on final consumers. All claims have been contested by the suspected companies.

By today´s decision one the largest aggregated fines ever for an allegedly anticompetitive agreement have been imposed on the companies. The case has been extensively covered by the press due to a significant biomass importance in the Vilnius central heating system, the public relevance of the central heating in Lithuania and various political statements.

The Competition Council’s decision can be challenged before the Vilnius Regional Administrative Court.
