Represented the interests of the creditors of a bankrupt company

Motieka & Audzevičius represented the interests of the creditors of a bankrupt company in an actio Pauliana case before the Court of Appeal.

The owners of a now bankrupt company, acting in bad faith, had made contracts which allowed them to transfer the assets of the company to third parties right before the company declared bankruptcy. The court of the first instance supported the arguments of the Motieka & Audzevičius team and declared these contracts null and void, as well as returned the assets to the company, allowing the creditors to satisfy their financial claims. The Court of Appeal dismissed a total of three appeal claims that were submitted by the parties who had made the unlawful contracts, and upheld the arguments of the Motieka & Audzevičius team, maintaining the decision of the court of the first instance.
