Our team has represented the operator of Lithuania’s natural gas transmission system in a dispute case before the Court of Appeal regarding the obligation to pay a special fee for the Liquefied Natural Gas (LNG) Terminal.
The court of first instance satisfied the client’s claim in part – obliged the defendant to pay a special fee but reduced the fine as manifestly excessive. Both the claimant and the defendant challenged this decision. The Court of Appeal dismissed the defendant’s claim and upheld all the arguments set forth by the Motieka & Audzevičius team and decided to satisfy our client’s claim in full scope, including the claim to award a fine.
This decision is of great importance as it ensures the financing of the LNG Terminal project which is one of the most important of Lithuania’s energy projects aimed at improving the energy security situation and creating conditions for a natural gas market.
