Important victory for the operator of Lithuania’s natural gas transmission system

Our team has represented the operator of Lithuania’s natural gas transmission system in an administrative dispute regarding the legality of legislation regarding the financing scheme of a Liquefied Natural Gas (LNG) Terminal.

The claimant challenged the decisions of the National Commission for Energy Control and Prices which had obliged the natural gas consumers to pay a special fee for the LNG terminal operation. The client was involved in the proceedings as a third party, in support of the defendant’s position.

Vilnius Regional Administrative Court upheld all the arguments set forth by the Motieka & Audzevičius team and dismissed the claim. The Court concluded that the contested Commission’s decisions complied with the existing legal regulation.

This decision has major importance in other cases in which the client seeks to recover more than 29 million euros of LNG Terminal fee debt.
