Successfully represented shareholders of natural gas supplier

Motieka & Audzevičius has successfully represented shareholders of natural gas supplier before the Court of Appeal in a dispute regarding the application of interim measures against the main shareholder. The question of interim measures arose in the civil case regarding the granting of a huge loan to a shareholder which contradicts the legal passive capacity of a legal person.

The conditions of a loan contradicted the goals of a legal person to seek profit and therefore clients submitted a claim requesting for the loan to be declared null and void.

Although the first instance court had dismissed an application for interim measures, the appellate instance court overturned the ruling of the first instance court stating that there is a high probability that Motieka & Audzevičius’ client’s rights could be infringed and interim measures must be applied.
