Thermal energy price setting

Motieka & Audzevičius represented one of the largest biodiesel producers in the Baltic States against the National Control Commission for Prices and Energy (NCCPE) regarding price setting for thermal energy supplied for manufacturing purposes.

Our client applied to the NCCPE, which agreed that thermal energy supplied for manufacturing purposes via constructed pipelines fall out of the scope of regulation imposed by the NCCPE. The dispute was concluded with a unilateral contract amendment in the client’s favour and the NCCPE not applying the thermal energy price according to the NCCPE higher rates.
