Represented the client in a civil case

Motieka & Audzevičius dispute resolution team has successfully represented the client as a defendant in a civil case before the Vilnius Regional Court. After hearing the case, the court has dismissed both appeals (brought by the claimant and National Land Service) and upheld the judgment of the court of the first instance in favor of the client.

The main subject of this legal dispute was rights in state land, which was leased to our client and had been occupied with buildings, owned by the same client. More precisely, the claimant and third parties requested to annul all the administrative acts related to this land and aforementioned buildings, as well as the lease contract of this state land – more than 20 acts and agreements in total.

However, Motieka & Audzevičius dispute resolution team managed to defend the position of the client and convince the Vilnius Regional Court that the state land was legally leased to the client. The court also agreed that both – a one-month time limit to challenge administrative acts and a general 10-year limitation period for civil claims – were missed.

Because of this favorable judgment, our client will be able to maintain the lease contract of the state land, which is important to its activities.
