Victory in dispute regarding termination of the agreement and compensation of the damages suffered

Our client entered into a production and supply contract with a Lithuanian producer.

A dispute arose between the parties when probably due to economic tensions the manufacturer began aggressively demanding advance payments that the customer was not obligated to pay. As our client refused to make the advance payments, the manufacturer in turn stopped the supply of production. The dispute arose whether our client terminated the agreement legally.

The court upheld our client’s position and granted the client’s counterclaim to award compensation. The court upheld our Dispute Resolution lawyers’ interpretation of the agreement by relying on extensive amount of factual evidence collected in the course of the parties contractual relationship.

As a result, the court decided that the manufacturer’s claim for compensation and illegality of the termination of the agreement was unfounded, and the our clients; claim for debt and lost income should be satisfied in full.
