Represented an energy company regarding the recognition and enforcement of an arbitral award

Motieka & Audzevičius has represented a leading international energy company in litigation concerning the recognition and enforcement of an arbitral award rendered by the arbitral tribunal constituted under the SCC rules. The dispute arose between the company and a Lithuanian government body.

The aforementioned case was focused on a breach of the arbitration agreement concluded in the Shareholders agreement. The arbitral tribunal concluded that the initiation of the Lithuanian court proceedings by the government body was in breach of the arbitration agreement contained in the Shareholders agreement and ordered the government body to withdraw part of its claims in the national courts.

This is one of the rare cases at the European Union level where the arbitral tribunal has ordered a party to withdraw its claim that had been raised in a national court.
