Represented one of the largest U.S. business media publishers in an international reputation dispute

Our dispute resolution team represented one of the world’s most authoritative financial and business media publishers in a defamation case and business reputation case heard before a U.S. court.

The evidence critical to the client’s defense was not located in the U.S., but in Lithuania: it required testimony from a Bank of Lithuania employee and documents held by the institution. The situation was further complicated by the fact that the Bank of Lithuania opposed the deposition, citing the risk of disclosing information constituting a Bank of Lithuania secret. Without this evidence, the client would have been left without a key part of its position in the U.S. proceedings, and failing to obtain the necessary information would have affected its defense against monetary claims.

We represented the client before the Lithuanian courts, seeking an order to compel the witness testimony and production of documents. The work included procedural representation in court, legal advice to the client and its U.S. counsel on aligning the requirements of two jurisdictions, as well as organizing the deposition and the production of documents. The process took nearly a year and required intensive preparation and continuous coordination between the Lithuanian and U.S. teams – making this one of the first U.S. discovery processes carried out in Lithuania involving the Bank of Lithuania within the practice of international dispute resolution.

Following a favorable court decision, the completion of the deposition and receipt of the required documents, the plaintiff withdrew the claim – the client avoided prolonged litigation and the risk of a final court judgment.

In international disputes, the outcome is often determined by evidence located in a country other than the one where the proceedings themselves are taking place, and a local legal team capable of reconciling the requirements of different jurisdictions provides a decisive strategic advantage.
