Secured nearly EUR 100,000 in damages in a lease tender dispute

Our Dispute Resolution team successfully represents a client in a case concerning the legality of the lease tender decisions of the Zarasai District Municipality’s Public Health Center.

The former tenant and subtenant, who lost the tender, initiated court proceedings challenging both the tender’s legality and the termination of the previous lease agreement. By obtaining interim measures, they managed to suspend the procedures and continue using the premises at a rent six times lower than the price offered by the tender winner.

Assessing the damage caused to our client, our team filed a motion with the court to secure compensation of EUR 93,600. Although securing damages is rarely applied in practice, we successfully proved all the necessary conditions for its application. The motion was upheld by both the first instance court and the Lithuanian Court of Appeal, thereby setting an important precedent.

This marks a significant interim victory – our client’s interests have been safeguarded, and it has been ensured that, should the case be won, the damages suffered due to the dispute will be effectively compensated.
