Successful annulment of three creditor’s decisions in a bankruptcy case

Our Dispute Resolution team, representing a client who is a creditor in a bankruptcy case, filed a complaint regarding the annulment of the creditors‘ decisions.

During the bankruptcy proceedings our client is involved in, the adverse insolvency administrator called and organized the meeting of creditors three times to make negative decisions for our client.

The court of the first instance as well as the Court of Appeal of Lithuania supported our arguments. It annulled all the decisions of creditors’ meetings, emphasizing that the insolvency administrator acted unlawfully. It was a triple win that will create an advantage for the client in related complex disputes.
