Successful representation during investigation of the Competition Council

Motieka & Audzevičius Regulatory and Antitrust team represented the client in the case National Competition Authority (NCA) vs various suppliers and wholesale and retail distributors of construction materials. NCA suspected a wide cartel and/or vertical agreement to fix and or maintain resale prices by suppliers and distributors of construction materials.

Our team actively represented the client in the investigation and sought to both prove non-participation in agreements prohibited by Article 5(1) of the Law on Competition of the Republic of Lithuania, Article 101 of the Treaty on Functioning of the EU (TFEU) and to provide the NCA with all the necessary information it deemed to opportune. The authority acknowledged that there are no reasonable grounds for suspecting the infringement of the provisions of the TFEU or the Law on Competition.

The firm believes that the proactiveness of the client during the investigation was the key to termination of an investigation by the NCA after almost two years of investigation.
