Successful representation of the university in an administrative case

Our Dispute Resolution team successfully represented the Lithuanian University of Health Sciences in an administrative case regarding the legitimacy of the rector’s election.

In 2021, the Office of the Ombudsperson for Academic Ethics and Procedures issued a decision that the election of the Rector of the Lithuanian University of Health Sciences was held in violation of the applicable legal regulations, as the University Council electing the Rector was illegal and incomplete. This decision was based on the fact that several members were not appointed to the University Council during the election of the Rector and not all units of the University were represented.

The University initiated an administrative case in Vilnius Regional Administrative Court regarding the above-mentioned decision of the Office of the Ombudsperson for Academic Ethics and Procedures.

The Vilnius Regional Administrative Court upheld the University’s claim in full and annulled the contested decision. The court fully agreed with our arguments and acknowledged that the University Council at the time of the election of the Rector was of such a composition that it gave the right to legally elect the Rector.
