Successfully represented major auto dealer in EUR 10 million dispute

Dr. Paulius GrendelisSuccessfully represented one of the largest official dealers of Volkswagen, Audi, Cupra, and Seat in Lithuania in a dispute concerning a procurement valued at EUR 10 million.
The contracting authority organized a tender to acquire new Volkswagen vehicles worth EUR 10 million, attracting a significant number of suppliers. Although our client submitted the best offer, the contracting authority declared another supplier as the winner.
Following an in-depth analysis of the procurement documentation, it was determined that the contracting authority’s decision was unlawful — the winning supplier’s offer did not comply with the procurement requirements (technical specifications). Moreover, after our client submitted a complaint, the contracting authority allowed the selected supplier to modify its offer in a way that transformed a non-compliant bid into a compliant one, effectively allowing the submission of a new offer, which is prohibited under public procurement law principles.
Both the court of first instance and the appellate court fully upheld our arguments, recognizing serious violations of the principles of transparency, fair competition, and equal treatment. Consequently, the contracting authority’s decision was entirely annulled.
Achieved results create a strong basis for our client to win the tender and to organize the supply of new Volkswagen vehicles in Lithuania.
