Dmitrijus Mačiuginas

Dmitrijus has over 9 years of experience representing international and domestic clients in complex, cross-border commercial, administrative (incl. regulatory) and investment disputes, with a particular focus on the application of EU law and the impact of decisions by public authorities on business.

Before the Lithuanian courts, at every instance, he has accumulated substantial experience in high-value damages claims, shareholder disputes, business activity restrictions and liability, licensing and regulatory change matters, as well as disputes concerning the application of EU sanctions and the recovery of EU funds. Dmitrijus has also acted in landmark disputes against national supervisory authorities with strategically significant impact on the energy and other regulated sectors. Many of these matters raise questions of national and EU law complex enough that the national courts turn to the EU courts for guidance – he currently acts in matters giving rise to three preliminary references pending before the Court of Justice of the European Union.

In the field of international disputes, Dmitrijus represents clients in commercial and investment arbitration under various rules (incl. ICC, LCIA, UNCITRAL and SCC), in disputes concerning investment protection, state liability and complex multi-jurisdictional matters. His practice also covers exequatur proceedings in Lithuania and in the Nordic countries, award set-aside and annulment proceedings, and the recognition and enforcement of foreign judgments and arbitral awards across multiple jurisdictions – including securing the finality of a client’s investment treaty award before the Swedish courts.

Alongside practice, Dmitrijus is actively engaged in academic work in the fields of administrative law, administrative procedure and arbitration, delivering lectures and seminars at Mykolas Romeris University.
