Case regarding sale and purchase agreements

Our law firm represented a client at the court of first instance in a case regarding sale and purchase agreements that infringed the interests of the client and its creditors.

The client argued that the agreements were actually fictitious transactions, made only for the sake of appearance and without the intention to create legal effects. Moreover, these transactions infringed the rights of the client and its creditor because they made it possible to take over the assets of a bankrupt company for a price that was lower than the market value of these assets.

The Court ruled in favour of the client and recognized the agreements as null and void, returning the assets to the disposition of the client.
