European Commission complaint regarding tax dispute

The Motieka & Audzevičius team has filed a complaint to the European Commission in a taxation related dispute regarding the possible breach of EU law, namely the incorrect implementation of an EU directive. The defendant in this matter is the Lithuanian Customs Department, Tax Dispute Commission under the Government of the Republic of Lithuania and Vilnius Regional Court.

The European Commission has requested the Lithuanian institutions to provide written explanations about the raised issued. The European Law Department under the Ministry of Justice has gathered the relevant information from various Lithuanian institutions and submitted it to the EU Commission. At the moment, one of the European Commission directorates has already confirmed that the EU directive on the Plant Protection Products was implemented incorrectly in Lithuania.

The issue was further transferred to the Taxation and Customs Union Directorate-General of the European Commission and we are currently awaiting its decision on the application of EU law related to the customs taxation.
