Represented the client in a complex case before the Vilnius Regional Court

Motieka & Audzevičius Dispute Resolution team successfully represented the client in a very complex case before the Vilnius Regional Court.

The case concerned an ICSID counterclaim filed by the Ministry of Energy representing the Republic of Lithuania before the Vilnius Regional Court amid adoption of the Achmea ruling and EU Member states’ agreement on the intra-EU BIT Termination Agreement. However, the Vilnius Regional Court has refused to examine the State’s claim based on lis alibi pendens considerations.

The case involved complex questions of international investment and public international law, parallel international arbitration proceedings.
