Recognition and enforcement of arbitration award in Serbia

Motieka & Audzevičius’ team in cooperation with a local counsel has won a case regarding recognition and enforcement of a GAFTA arbitration award in Serbia.

Request for recognition was satisfied six months ago, however the defendant appealed and the appellate court referred the case back to the lower court. The court of first instance has again decided to recognise and enforce the abovementioned arbitration award.

One of the important issues in this case was that a company requesting recognition and enforcement of the award wasn’t a party involved in the arbitration proceedings. Our client bought the claim from the initial claimant. This fact in itself has raised significant disputes among the parties whether the award is enforceable by the third party.
