Our lawyers have defended an auto trading company in a dispute with the Tax Authorities. The client was assessed with additional VAT due to the sale of goods to another EU Member State and the application of 0% VAT rate. The Tax Authorities tried to prove that the goods never actually left the country and a standard VAT rate was to be applied. Burden of proof and the level of prudency of an average business person were the main issues in the dispute.
